April 2012: Diplomatic Appointment for Head of Chambers
Prime Minister Julia Gillard and Foreign Minister Bob Carr today announced that our Head of Chambers, John McCarthy QC, will be Australia’s next Ambassador to the Holy See. Mr McCarthy is expected to take up his appointment in September 2012.

March 2012: Favourable High Court Decision
The High Court today (28/3/12) handed down its decision in Phonographic Performance Company of Australia Limited (PPCA) & Ors v Commonwealth of Australia & Ors [2012] HCA 8. The Court rejected a Constitutional challenge to the validity of caps imposed by the Copyright Act 1968 on certain royalties for the broadcast of sound recordings. John Sheahan SC, leading Cameron Moore SC, appeared for the ABC, one of the successful defendants.

March 2012: Interlocutory injunction granted for the patentee
Cynthia Cochrane, led by Tony Bannon SC and briefed by Allens Arthur Robinson, successfully obtained an interlocutory injunction for the patentee in relation to a method of treatment involving aripiprazole, a drug used in the treatment of schizophrenia and bipolar disorder. See Otsuka Pharmaceutical Co Ltd v Generic Health Pty Ltd [2012] FCA 239.

March 2012: Successful Federal Court Appeal
Dale Bampton, appearing with Justin Gleeson SC on behalf of Singtel Optus Pty Limited, successfully appealed to the Full Court of the Federal Court of Australia (Keane CJ, Finn J and Gilmour J) from a pecuniary penalty imposed by Perram J under the Trade Practices Act. The Full Court allowed Optus’ appeal and reduced the pecuniary penalty imposed on Optus by $1.65 million.
